What types of cases are handled in New Jersey Municipal Court?
Municipal Courts handle traffic violations (speeding, reckless driving, DUI/DWI), minor criminal offenses known as disorderly persons or petty disorderly persons offenses (like simple assault or shoplifting), and municipal ordinance violations (noise complaints, zoning issues). Municipal Court hears the vast majority of legal cases in New Jersey.
What is the difference between a disorderly persons offense and an indictable crime?
A disorderly persons offense is a minor criminal matter heard in Municipal Court, carrying a fine and/or up to six months in jail. An indictable crime is more serious, heard in Superior Court, and can carry a prison sentence of a year or more.
How will a DUI/DWI conviction affect my driver's license?
A conviction can result in license suspension, fines, and mandatory attendance at the Intoxicated Driver Resource Center (IDRC), with the specifics depending on your BAC and other factors.
Can I get a traffic ticket dismissed or reduced?
In many cases, an attorney can negotiate with the municipal prosecutor to get a ticket dismissed or reduced, helping avoid points, higher insurance premiums, and other penalties.
What is the 'IDRC' and why do I have to go there?
The IDRC is a state-mandated program for DUI/DWI convictions involving education and screening for substance abuse issues. Failure to attend can result in additional penalties, including a longer suspension.
What is the point system in New Jersey?
The Motor Vehicle Commission tracks driving offenses through a point system. Six or more points require a surcharge, and 12 or more points result in license suspension.
Do I have to appear in court for a traffic ticket?
Not always — but more serious violations like DUI/DWI or reckless driving require a mandatory court appearance. An attorney can often appear on your behalf for many matters.
