How Much Does the Divorce Cost? Two Most Common Asked Questions When Shopping for a Divorce Lawyer

In New Jersey, the cost of a divorce varies. That’s the first question I’m usually asked is, “How much is this going to cost me?”

It’s almost impossible to tell you unless the divorce is uncontested, which means that there are no assets, no children, and no issues. A divorce with high assets or assets such as home ownership or children doesn’t have to be expensive if the parties can come to an agreement early on or even before they get divorced. The cost typically is going to start at least $1,500.00, plus the filing fee, for an uncontested divorce. If it’s a contested divorce and there are assets and issues of custody and child support, initial retainer could be anywhere from $3,500.00 to $5,000.00 or more depending on the particular circumstances.

How Long Does it Take to Get Divorced?

The second question I am often asked is, “how long it takes to get divorced?”  In New Jersey, divorces are a creature of the particular factual situation involving the parties. As an experienced Attorney in Jersey City, I’ve had divorce cases where people have been divorced in about 30 days; I’ve had cases where people don’t get divorced for a year and a half, sometimes longer. Every divorce is different, and every factual situation would determine how quickly a divorce can happen. If there are a lot of assets and the parties can’t come to an agreement, that divorce is going to take much longer. If there are no assets, or if there are plenty of assets but the parties are in complete agreement, that divorce is going to be much quicker and far less expensive.
